What does a property litigation lawyer do?

A property dispute solicitor who specialises in property litigation can help to resolve disputes between neighbours, property owners and their tenants. Some of the more common areas include:

  • Boundary disputes – including party wall disputes, fence and hedge disputes.  For instance if a neighbour erects a fence or shed on what you believe is your land. Or disputes over who is responsible for the maintenance of fences.
  • Rights of way/rights of access – these disputes generally occur when you are prevented from using a right of way because there is a locked gate.
  • Adverse possession claims  and other land title disputes. For example the process to claim ownership of land or property that they have used without the permission of the owner for a certain period of time (typically 10-12 years).
  • Challenging, Removing or Enforcing Restrictive Covenants. Although it may be possible to negotiate and agree the removal or enforcement of a restrictive covenant, sometimes there may be a need to make an application to Court or Tribunal.
  • Neighbour disputes – including nuisance actions and harassment. Although for these sorts of situations it’s best to contact the local authority and/or police, in some occasions dispute resolution or mediation may be able to help.
  • Professional negligence claims against builders, surveyors, architects engineers and solicitors.
  • New build disputes. For example your new home does not meet the standards to which it should have been built or you believe your developer is in breach of contract. Litigation is notoriously expensive in this area and should only be considered if you have exhausted all other avenues to getting your problems fixed.

Dispute resolution versus litigation?

Dispute resolution and litigation offer two different ways of resolving your legal issue. In general, dispute resolution such as mediation can be a way of solving a conflict or disagreement without going to court.

Unsurprisingly, most parties prefer to try dispute resolution before they then move on to litigation, as it is generally less expensive and contentious than settling matters in court. Since so many issues can crop up in the field of property, solicitors will often suggest dispute resolution, and help you through the process, only moving to litigation if absolutely necessary.

If the potential dispute or claim may be less than £10k, then it is likely not to be economic to instruct a property litigation solicitor as you can’t claim your own legal costs back from the other side.

However, of course, most cases don’t actually make it to court – an initial involvement from solicitors often does the trick.

How can a solicitor help with a boundary dispute?

An experienced property dispute solicitor will be able to determine your rights and resolve the dispute quickly and painlessly.

Our partners at Bonallack and Bishop can provide you with initial advice to see if you have a case worth pursuing. They may be able to suggest ways of seeking an acceptable outcome which you might otherwise not have considered. At times when personal feelings are running high and tempers are flared, it can be hugely beneficial to have the input from someone who is not only impartial and able to see the situation for what it is, but is also highly qualified in resolving exactly these types of dispute.

Subject to your instructions, your property dispute solicitor will try to resolve any issues by negotiation – without the need of expensive litigation. However, when there is no option but to go to Court, the experienced team at our partners Bonallack and Bishop can also fight your corner there.

How can a solicitor help with a neighbour dispute?

Our experienced solicitor partners specialise in neighbour disputes and can help to resolve the issues by initially speaking to the neighbour and writing to them to let them know your grievances and suggest a way in which the dispute could be resolved.

Sometimes a simple and relatively inexpensive solicitors’ letter can solve the problem. It certainly tells your neighbour that you are taking the dispute seriously. If your neighbour is flouting laws or regulations, your lawyer may point this out and let them know that their actions could result in legal action being taken against them. In many cases, this will lead to the dispute being resolved as most people will not want to end up in court.
